Pro Hac Vice

Before you start, please gather the following information:

  • The applicant attorney’s license number in their primary jurisdiction.
  • The license number of the Pennsylvania attorney of record (sponsoring attorney), which can be found on the Pennsylvania Disciplinary Board’s website: www.padisciplinaryboard.org.
  • If you are seeking pro hac vice admission for a consolidated case, only a single fee is necessary. Please provide the lead case name and docket number when submitting your application and attach a copy of the consolidation order.
  • If the client being represented has been granted in forma pauperis status, include a copy of the motion or order granting leave to proceed in forma pauperis.

What to expect when you submit

  • The acknowledgement letter will be sent by email to the applicant’s contact person on the application and the sponsoring attorney.
  • The acknowledgement letter will be sent within three (3) business days of receipt of a completed application and admission fee.

No Refunds: Pursuant to 204 Pa Code § 81.505(a), no refunds will be issued under any circumstances.

Fee & Payment Options

The admission fee is $375.00 per attorney per case. If paying online by credit card, a convenience fee of $2.75 will be added to the total. Visa, MasterCard, and Discover are accepted.

If paying by check, money order, or cashier’s check, submit the online application and mail the voucher with payment made payable to the Pennsylvania IOLTA Board.
If your check is dishonored due to insufficient funds or other reasons, the Pennsylvania IOLTA Board will notify you and charge a $25 fee plus any associated returned item charges from its bank.

Processing Time

The Board will process the application within three (3) business days of receipt of a completed application and admission fee. Same day processing is not available.

An application will not be processed if:

  • required information was not provided;
  • required questions were not answered; or
  • the required fee was not paid.

Does this pro hac vice admission payment procedure apply to attorneys not licensed in Pennsylvania who are employed by governmental or non-profit entities?

Yes, the same regulations apply to all attorneys without regard to the attorney’s employer.

Is a payment form and admission fee required for state agency appearances or counsel in depositions where no court appearance is involved?

No. The rule does not apply to administrative agency proceedings, cases in federal courts located in Pennsylvania, or situations not involving the entry of an appearance before a Pennsylvania court.

Is a payment form and admission fee required for minor courts, (such as Magisterial District Courts, Municipal Courts, and Traffic Courts)?

Yes, it is necessary to submit the form and pay the fee in order to appear before a magisterial district court or Philadelphia Municipal Court (except for Traffic Division), as defined in applicable regulations.

Will the admission fee be refunded if the case is dismissed?

No. The admission fee will not be refunded if the case is dismissed, nor will an admission fee be refunded if you never file your motion, withdraw your motion, or do not meet all requirements for admission.

Does an attorney not licensed in Pennsylvania have to be associated with a Pennsylvania attorney?

Yes, as referenced in Pennsylvania Rule of Civil Procedure 1012.1(b) and 204 Pa. Code 81.503(d) admission pro hac vice requires an attorney admitted to the Pennsylvania bar to sponsor the candidate seeking pro hac vice admission.

Do the pro hac vice payment form and admission fee apply when a matter is set for arbitration?

The payment form and admission fee are required if the attorney not licensed in Pennsylvania must enter an appearance in a Pennsylvania Court.

Will one payment form and admission fee suffice for multiple cases?

No. An attorney not licensed in Pennsylvania must submit a separate payment form and admission fee for each case in which the attorney is seeking to appear pro hac vice. See 204 Pa. Code 81.505(a).

Can a single check be submitted to pay for more than one pro hac vice admission?

Yes. However, all vouchers should be submitted together with the payment in the appropriate total amount.

How do I correct an error on the acknowledgement letter?

A request to correct an error on the acknowledgement letter must be made in writing to the Pennsylvania IOLTA Board. Submit written requests for corrected acknowledgement letters to paiolta@pacourts.us, including the attorney’s name, application date, and the specific correction needed.

Is a new payment form and admission fee required if a case is appealed to an appellate court?

No. The payment form and admission fee covers the attorney for that case until a final determination of the case, including appellate review, is made, or until issuance of an order permitting the attorney to withdraw from the case.

How does the Board use the funds received from the collection of pro hac vice fees?

Pro hac vice admission fees received by the Board are used to fund the IOLTA Loan Repayment Assistance Program (LRAP) which benefits attorneys employed by IOLTA-funded legal aid organizations.
